General Terms and Conditions
1. General
1.1 The General Terms and Conditions (GTC) regulate the contractual relationship between the Offenbach Shuttle Service and the client regarding the transport of passengers in rental car traffic.
1.2 The customer is liable for all damage to the vehicle that he causes. This includes cleaning the interior and exterior as well as damage to the paintwork or interior if this was caused intentionally, through gross negligence or due to excessive alcohol consumption. Persons or objects that endanger the safety of other passengers or the driving staff will be excluded from transport. The Offenbach Shuttle Service accepts no liability for lost or forgotten objects in the vehicle.
1.3 By concluding the contract, the customer agrees to the Offenbach Shuttle Service's general terms and conditions. Deviations from these general terms and conditions are only valid if they have been recorded in writing. Verbal agreements are not binding. Should a clause of the contract be ineffective or void, the rest of the contract remains valid. In such a case, the contracting parties undertake to replace the ineffective clause with a legally effective provision that comes closest to the original economic objective. The same applies to any gaps in the contract.
2. Booking & Payment
2.1 Offenbach Shuttle Service determines the travel routes, departure times and locations in consultation with the customer. However, there is no entitlement to transport - the acceptance of an order is at the discretion of the driving service and its authorized representatives.
2.2 A contract is only concluded when the order has been accepted and confirmed by the transport service by telephone, fax or email. This acceptance does not require a specific form, but can also be confirmed in writing at the customer's request.
2.3 Payment is made after the service has been provided in cash, by debit or credit card or, by arrangement, by invoice. Changes to services or prices will be communicated to the customer immediately. In such cases, the customer has the right to withdraw from the contract free of charge.
3. Promotion & Performance
3.1 The agreed pick-up times and addresses are binding, but the pick-up time may vary by up to 30 minutes. If the vehicle does not arrive at the pick-up location after these 30 minutes, the customer must inform the Offenbach Shuttle Service on +49 175 - 85 00 555.
3.2 No liability is accepted for incorrectly specified addresses, flight numbers, departure, arrival or pick-up times, including for consequential damages. If the vehicle does not arrive at the airport at the agreed time or if the driver and customer miss each other, the Offenbach Shuttle Service must be notified by telephone.
3.3 The Offenbach Shuttle Service is liable within the scope of its duty of care for the careful planning and proper execution of the journey, but liability for breaches of contract or tort claims is limited to intent and gross negligence.
3.4 Delays due to force majeure such as bad weather, traffic jams, accidents, breakdowns, third-party fault, strikes, riots, natural disasters or similar events exclude liability. In other cases, liability is limited to the additional costs for replacement transport on the same route by an alternative transfer company.
4. Lack of staff & vehicle defect
4.1 In the event of a bottleneck, for example due to last-minute sick leave or vehicle breakdown, the Offenbach driving service reserves the right to pass the order on to a partner company in order to avoid having to cancel the transfer. In this case, the booking details are sent to the partner company so that the order can be carried out smoothly. The agreed conditions remain unchanged. However, if it is not possible to find a partner company with free capacity and the order has to be canceled, the customer will be informed immediately. Amounts already paid online will of course be refunded immediately.
5. Cancellation by customer
5.1 The customer has the option of withdrawing from the contract with the Offenbach Shuttle Service up to 12 hours before the agreed pick-up time. However, the withdrawal must be reported as early as possible. If no cancellation is made and the booked transfer is not used, the full transfer price must be paid and the customer will be charged 100%.
